Terms & Conditions

1. Definitions

In these Terms and Conditions:

  • "Company" refers to Albandeira Ecotours, located at Estr. de Albandeira, 8400-232 Lagoa, Portugal.
  • "Customer" refers to any individual or group who books or participates in any of our tours or rentals.
  • "Activity" refers to any guided tour or self-guided rental offered by the Company.
  • "Booking" refers to any confirmed reservation made through our booking system or directly with the Company.

2. Bookings and Reservations

  • Reservations are required for all tours and rentals. Walk-ins are accepted subject to availability.
  • Bookings made through FareHarbor are subject to FareHarbor's additional terms of service.
  • A booking is confirmed only upon receipt of full payment (or deposit as specified).
  • The Company reserves the right to refuse a booking at its discretion.
  • By completing a booking, the Customer agrees to these Terms and Conditions in full.

3. Pricing

  • All prices are quoted in Euros (€) and include applicable taxes.
  • The Company reserves the right to adjust prices at any time. Confirmed bookings will honour the price at time of booking.
  • Prices for private tours are provided at the time of booking enquiry and may vary based on group size and requirements.

4. Weather and Sea Conditions

  • All outdoor water activities are subject to weather and sea conditions.
  • The Company reserves the right to cancel or modify any activity if conditions are deemed unsafe by our guide or staff.
  • The safety of our Customers and guides is always our highest priority. Safety decisions are made at the Company's sole discretion.
  • We will attempt to inform Customers of any changes as early as possible.
  • Tours cancelled due to bad weather or sea conditions will receive a 100% full refund.
  • No compensation is provided for cancellations due to weather beyond a full refund of the activity price.

5. Cancellation Policy

Cancellation by the Customer

  • Cancellations made 48 hours or more before the activity: full refund
  • Cancellations made 24–48 hours before the activity: 50% refund
  • Cancellations made less than 24 hours before the activity: no refund
  • No-shows: no refund

Cancellation by the Company

  • Cancellations due to weather or sea conditions: 100% full refund
  • Cancellations for any other reason by the Company: 100% full refund

6. Equipment Policy

  • All equipment provided by the Company must be returned in the same condition in which it was collected.
  • Customers are responsible for any damage caused to equipment through negligent or deliberate misuse.
  • The Company will assess the condition of equipment upon return. Costs for repair or replacement of damaged equipment will be charged to the Customer.
  • Lost equipment will be charged at replacement value.
  • For stand-up paddle boards: a security deposit may be required if the Customer requests the keel attachment. This deposit is refunded upon return of equipment in undamaged condition.

7. Weight and Physical Requirements

  • The weight limit is 90 kg per seat for all kayaks.
  • Each double kayak accommodates 2 adults and 1 child.
  • Customers with medical conditions that may be affected by kayaking or paddling should consult their doctor before booking.
  • Pregnant women are advised not to participate in kayaking or SUP activities.
  • The Company reserves the right to refuse participation if a Customer's physical condition is deemed unsafe.

8. Safety

  • All Customers must follow the safety instructions provided by the guide at all times.
  • Safety equipment (life jackets, etc.) is mandatory and must be worn for the duration of the activity.
  • Customers who disregard safety instructions may be removed from the activity without refund.
  • Swimming is permitted at the guide's discretion in approved areas only.
  • The guide's decisions on safety matters are final.

9. Liability

  • Participation in water activities carries inherent risks. Customers participate at their own risk.
  • The Company is not liable for any personal injury, loss, or damage suffered during activities, except where caused by the Company's negligence.
  • Customers are advised to have adequate travel and activity insurance before booking.
  • The Company is not responsible for personal belongings lost or damaged during activities.
  • A waterproof bag is provided for the protection of personal items; however, the Company assumes no liability for their safety.

10. Photography and Media

  • The Company may photograph and film activities for promotional purposes. By participating, Customers consent to their image being used in promotional materials unless they notify the guide otherwise before the activity.
  • Photos taken of Customers during tours are provided as part of the included service.

11. Environmental Responsibility

  • Customers must not disturb wildlife or marine habitats during activities.
  • No litter or waste of any kind may be deposited in the ocean, on beaches, or in sea caves.
  • Customers who act in violation of environmental guidelines may be removed from the activity without refund.

12. Governing Law

These Terms and Conditions are governed by Portuguese law. Any disputes arising from bookings or activities shall be subject to the jurisdiction of the Portuguese courts.

For out-of-court dispute resolution, please refer to our Dispute Resolution information in accordance with Portuguese consumer protection law (Lei n.º 144/2015).
